These Terms and Conditions ("Terms") govern your use of the SwiftWind Studio website ("Service"). By accessing or using the Service, you agree to be bound by these Terms. We reserve the right to refuse service to anyone who violates these Terms.

1. Use of the Service

  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
  • To impersonate or attempt to impersonate REALWEB, a REALWEB employee, another user, or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing).
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm REALWEB or users of the Service or expose them to liability.

2. Purchases

  • If you wish to purchase any product or service made available through the Service, you may be asked to supply certain information relevant to your purchase.
  • You represent and warrant that you have the legal right to use any credit card or other payment method used in connection with any purchase.
  • We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price, errors in your order, or suspected fraud.

3. Content

  • Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content").
  • You are responsible for the Content you post, including its legality, reliability, and appropriateness.
  • By posting Content on the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, reproduce, adapt, publish, translate, create derivative works from, distribute, and display such Content in any media.

4. Delivery and Access

4.1 Delivery Method

Upon successful completion of your purchase and payment, you will receive an email containing instructions on how to access and download the SwiftWind Studio software. This may include a link to a download page, a license key, or other relevant information.

4.2 Access to Updates and Support

Depending on your subscription plan, you may be entitled to software updates, bug fixes, and customer support for a specified period. Details regarding updates and support are outlined on our website and in your subscription agreement.

4.3 Delivery Timeframe

Delivery of the software is typically immediate upon completion of your purchase. In rare cases, there may be a slight delay due to technical issues. If you do not receive your access instructions within 24 hours of purchase, please contact us for assistance.

4.4 Responsibility for Access

You are responsible for maintaining the security of your account credentials and ensuring that you have the necessary hardware and software to access and use the SwiftWind Studio software.

4.5 No Refunds for Digital Products

Please note that due to the nature of digital products, we generally do not offer refunds once access to the software has been provided. However, we may consider exceptions in certain circumstances, as outlined in our Refund Policy.

5. Refunds

5.1 Eligibility

Due to the nature of our SaaS product, we offer a limited refund policy. Refunds may be considered within 14 days of purchase under the following circumstances:

  • Technical Issues: If you experience significant technical issues with the software that we are unable to resolve within a reasonable timeframe.
  • Non-Delivery: If you have not received access to the software within 24 hours of purchase, and we are unable to resolve the issue.

5.2 Non-Eligibility

We generally do not offer refunds for the following reasons:

  • Change of Mind: If you simply change your mind about the purchase.
  • User Error: If issues arise due to user error or failure to meet the necessary technical requirements.

5.3 Refund Process

To request a refund, please contact our customer support team with your order details and a clear explanation of your reason for requesting a refund. If your request is approved, the refund will be processed to your original payment method.

6. Cancellations

6.1 Subscription Cancellations

You may cancel your subscription at any time by following the instructions in your account settings or by contacting our customer support team. Cancellations will take effect at the end of your current billing cycle.

6.2 Prepaid Plans

If you have purchased a prepaid plan, you may request a cancellation and refund within 14 days of purchase, provided you have not accessed or used the software.

7. Accounts

  • When you create an account with us, you must provide accurate, complete, and current information.
  • You are responsible for safeguarding your password and for any activities or actions under your password.
  • You agree not to disclose your password to any third party. You must notify us immediately of any unauthorized use of your account.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

9. Disclaimer

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
  • We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall REALWEB, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use ofthe Service.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
